Purchase terms (pre-contract notice)

I. Overview

These Purchase Terms (Pre-Announcements) are part of the Seller's obligations under the Consumer Protection Act and serve to ensure that the Buyer prior to reaching a distance contract is informed in a clear and understandable manner of a number of circumstances relevant to the conclusion, execution, termination of the contract in accordance with legal regulations.

The term of seller refers to:

The term Buyer refers also to: a classical consumer (a physical person who orders and pays any product outside any activity by means of a web store service present on the Seller's website), but also to the customers of legal entities, tradesmen and traders of individuals and natural persons who perform but the latter are protected by the provisions of the Consumer Protection Act only if they buy products that are not related to their business.

The seller sells through the Internet site www.modelineshop.com performs in his name.

The terms of the purchase (pre-contract notice) form part of the distance contract together with the specifications and the price of the purchased product, and before ordering the purchase order of a particular product from the Buyer, it will request that it accept / declare that it is aware / while after the order confirmation (the conclusion of the contract) the same will be delivered to the Buyer as the content of an e-mail confirming that the contract was concluded. III. Product price

Prices displayed on the websitewww.modelineshop.com are expressed in euros and VAT included in them. In prices the product does not include the specially paid shipping costs. The Loyalty Club card will not be charged for outlet products.

In the case of payments by general payment, costs of interbank transactions are not included in the price.

IV. The General Terms and Conditions of the Modeline Loyalty Program Club

The owner of the Modeline Club Card can become any person completing the form in one of the Modeline stores or in the Modeline Web Shop.

Customers from Zagreb will receive a card with a unique number and a bar code that will be able to get discounts in stores and online purchases. In order to make a discount on the web shop, you must enter your username and password and enter a barcode from card.

A member of the Club of Loyalty through an online purchase can become anyone who wants to make a 5% discount when choosing a product or become a member of the Loyalty Club.

The buyer will receive a virtual card with a unique number and bar code on the e-mail. In order for a user to collect points, each user must register with their username and password each time they are online. The virtual card can also be used when purchasing in a physical store so that the user saves the received e-mail.

The user also receives a detailed insight into the current status of the points and the current level of the achieved discount.

Whether a user has become a member of the Loyalty Club via online or in store, an activated membership does not need to be renewed.

By joining the Modeline loyalty club, the user has the right to a 5% discount on the first purchase whose value is entered into the Modeline Club System Collection points.

The collection system is based on the model one euro = one point, valid for all payment methods (e-banking, general payment, credit card - MasterCard, Maestro, Visa, Discover it, Diners)

Depending on the points earned, within a year the user has a certain discount:

All points earned are collected during the accounting period of one year, and the user will be able to use the discount granted by the end of the current and the next two years. The Modeline Club discount also applies to discounted items.

Once the assigned discount is used, the user begins to collect points (from the lowest grade).

Every year, the user collects points starting from the start, and the Modeline Club card can not be used as a mean of payment. Benefits can not be realized if you do not have your card with you.

If the user exceeds the current grade in the year in which he / she is in the year, he automatically switches to the higher class and places the right to use a higher grade until the end of the current and the next two years.

Modeline reserves the right to cancel membership at any time, if the member has violated these terms and conditions and has unconditionally agreed to complete the application form for the Modeline Club Club's loyalty program.

Modeline reserves the right to change the Terms and Conditions of Membership as well as the right to terminate the Model Loyalty Program Club at any time and without prior notice.

Loss of membership card is required to register via e-mail [email protected], and the member will be assigned a new card to which all the points earned so far will be transferred.

V. Delivery Costs

In the case of the inability to deliver at the Customer's address, the Buyer shall bear the cost of re-delivery to the same or different address depending on which Customer's information will be provided to the Seller when checking the order delivery.

For orders from Finland and Greece, the customer bears the cost of returns and replacements.

VI. Returns

All customers of the Modeline web shop have the right to return the order (unilateral termination of the Agreement) for all items. If the staff of the Modeline online shop assesses that the returned goods are undamaged and in the original packaging, we will issue a refund to your account. If the goods are not in proper condition (worn or the original packaging is damaged), you will have to pay delivery in the amount for your country have the goods sent back to your home address.

We will try to deliver all ordered items in one package. If this is not possible due to stock status, we reserve the right to deliver to multiple shipment.

IX. Single-sided termination of contract

Only a Buyer who has made a Contract on the distance in the manner described above has the right, without giving reasons for this, unilaterally terminate the contract within 100 days. The 100-day period shall begin to run from the date on which the Purchaser or a third party designated by the Buyer, who is not the carrier / consignor, the goods constituting the subject of the contract being surrendered. If a notice of unilateral termination is served within 12 months, the right to unilateral termination shall expire after the expiration of 14 days from the date o which the Buyer receives such notice.

The buyer is obligated before the expiration of the unilateral termination deadline to notify the Seller of his decision to terminate the contract by via One-sided cancel pattern which is available here which can be electronically completed and sent to the mail addres: [email protected]. Confirmation of receipt of a notice of unilateral termination of contract will be sent to you, without delay, by electronic mail.

If you unilaterally terminate this Agreement, we will refund the money we received from you, not including shipping costs, and within 14 days of receipt of your decision to terminate your contract, unless you have selected another delivery type, which is not the cheapest standard delivery we have offered. Refunds will be made in the same way that you made your payment. Refunds can only be made after the goods are returned to us or after you provide proof that you have sent us the goods back. You are obliged to return the goods immediately and within 100 days from the day you have submitted your decision to unilateral termination. It is considered that you have fulfilled your obligation on time if you send it in a valid way before the expiry of the above-mentioned deadline or deliver the goods personally to us at our office, or to the person we are authorized to receive goods. You are liable for any impairment of the goods resulting from the handling of the goods, except for what was necessary to determine the nature, characteristics and function of the goods. If the product is returned defective, with major damage or parts and documentation, and if it is not delivered within a further period of 8 days, it is considered that the Buyer has not fulfilled its obligation to return the goods and the Seller is not obliged to make a refund of the funds he paid.

X. Responsibility for material defects

The Seller is liable for the material defects of the things he sells on his pages in accordance with the positive regulations of the Republic of Croatia, in particular the Obligations Act.

Ordered products are packaged in a way that they will not be damaged by the usual manipulation in transport / delivery.

In the case of shipments damaged in transport, such damage is visible when picking up the shipment, and in this case we suggest that the shipment is not taken over by the Buyer. Please Buyers to contact us to check the shipment status as soon as possible and send a new one.

In the event of a shortage of goods when picking up the shipment, the Buyer is not obligated to take over the product, may refuse the receipt, and will not bear the costs of delivering the Shipment. Seller will consider a claim valid if the Product Review determines that it meets the terms of the complaint in accordance with the Mandatory Obligations Act and the Consumer Protection Act. In such case, within 15 days of the receipt of a valid complaint, the product will be replaced or the entire amount paid back will be repaid. If, however, it finds that the claim is not valid, ie if the claim is rejected, the Buyer will pay the shipping amount for your country to be returned to the home address.

XI. Contract duration

The contract concluded by the Buyer with the Seller is a one-time purchase contract for a product that is consumed by the shipment of the goods and made by the buyer, if it is not terminated. These Pre-Announcements are an integral part of the Contract.
